You are buying or selling a home in Naples and need to choose a notary. This page tells you, plainly, what we do for you from the preliminary contract to the handover of the keys. It also tells you what a deed really costs (taxes, fee, expenses), what you need to bring to our office, and how long it takes. If you want the precise figure for your case, ask for a written quote for the purchase or sale: it arrives in a short time.
What does the firm do for you in a sale?
The deed is the last step of work that begins weeks earlier. We trace the title history of the property for at least twenty years. We run mortgage searches to check there are no mortgages, seizures or pending claims. We check that the land registry plan matches the home and that the building permits (permits, amnesties, CILA, SCIA) cover what actually exists. We read the condominium rules and ask the building manager for a statement clearing any arrears. We check the energy performance certificate and, if there is a mortgage, we coordinate timing with the bank. Then we draft the deed, read it with you word by word, register it, record it in the land registry and update the cadastral records. If something does not add up, we say so beforehand, not on signing day: that is the point of our work as an impartial public official.
How much does the notary cost for a purchase in Naples?
The bill has three parts. Taxes are by far the largest and do not depend on the notary: we collect them and pay them to the State. The fee is the payment for advice, checks, drafting the deed and the related filings. It depends on the value and complexity of the deal (an unregistered inherited title, or an amnesty to follow up on, mean more work). Expenses are searches, archive tax, stamps and duties that we pay on your behalf in advance.
| Taxes on the purchase | First home | Other cases |
|---|---|---|
| Purchase from a private seller (registration tax) | 2% of the cadastral value (minimum €1,000) + €50 + €50 for the mortgage and land-registry taxes | 9% of the cadastral value (minimum €1,000) + €50 + €50 |
| Purchase from a company, with VAT | 4% VAT on the price + €200 + €200 + €200 (registration, mortgage, land-registry) | 10% VAT (22% for luxury homes) + €200 + €200 + €200 |
| Registered preliminary contract | Fixed €200 + proportional tax on the deposit and down payments (0.5% since 2025), recovered at the deed | |
For homes bought from a private seller, the price-value rule applies: taxes are calculated on the revalued cadastral income, not on the price paid, and the notary’s fee is reduced by law by 30%. An example: a flat in Fuorigrotta bought for €220,000 as a first home, with a cadastral income of €850. Cadastral value: 850 × 1.05 × 110 = €98,175; 2% registration tax = €1,963.50, plus €100 for the mortgage and land-registry taxes. Without the first-home benefit it would be €8,835.75. You can run the numbers for your own home with the purchase-tax calculator; we write the exact fee in the quote, with the items listed separately as the code of professional conduct requires.
Who pays the notary and when?
By law, the costs of the deed are borne by the buyer (art. 1475 of the Italian Civil Code), unless otherwise agreed. They are paid at signing, usually by bank transfer or cashier’s cheque into the firm’s dedicated account, together with the balance of the price. The seller, in turn, pays any capital gains tax. This applies if they resell within five years of buying and the home was not their main residence for most of that time.
What do you need to bring to the office?
- ID document and tax code for all parties; marriage certificate or certificate of single status.
- Title deed (purchase deed, inheritance, gift) and, if there is a mortgage in place, the bank’s details for releasing it.
- Building permits: permit or licence, amnesties, CILA, SCIA, occupancy certificate; a technical report on planning status if one has already been prepared.
- Energy performance certificate (APE), condominium rules and the building manager’s statement on expenses.
- Preliminary contract and receipts for the deposit and any down payments; for a mortgage, the bank’s approval.
You can get the list of documents tailored to your deed by answering four questions on the Prepare your request page; the forms to download are in the Download area. We take care of the land-registry and mortgage searches ourselves.
How long does it take?
The quote arrives in a short time. Once we have the documents, the checks and the draft deed take one to two weeks; if a planning procedure or a cadastral update is needed, the surveyor may need a few more weeks. With a mortgage, the signing date is set once the bank has given final approval. After signing, registration and recording happen within a few days and you receive the copy of the deed: what happens next is explained in After the deed is signed.

Frequently asked questions
Can the notary read the preliminary contract before I sign it?
Yes, and it is the most useful thing you can do. The preliminary contract sets the price, the deposit, the deadlines and who fixes any irregularities: correcting it beforehand costs nothing, afterwards it costs a negotiation. We can also receive it as a notarial deed and record it, so it is protected against mortgages or later sales.
Does the notary have to be from Naples?
A notary can receive deeds on properties anywhere in Italy, but must sign them within the region where they are based. Our office is at Via Cuma 6, 80132 Naples, and we handle deeds on properties throughout Campania and beyond; for those who are far away, there is the power of attorney.
The home has a veranda or an irregularity: can it still be sold?
Almost always yes: the deed is valid if it states the true building permit. But the irregularity passes to the buyer, along with any penalties. Before the preliminary contract, we have a surveyor check what counts as a tolerance, what can be regularised and what cannot: we cover this in the guide Planning compliance and legitimate status.
When do you get the keys?
At signing, together with the balance of the price. Moving in earlier is only possible with a written agreement covering costs, risks and what happens if the deed does not go through: we explain the risks in Getting the keys before signing.
