The bank has said yes, and now it is asking you for “the name of your notary”. You choose the notary for the mortgage, not the bank, and it pays to choose early: this is the professional who reads the draft contract with you and prepares the mortgage deed and the registration of the mortgage lien. We coordinate the disbursement with the purchase deed, and in later years we help with refinancing, assumption or discharge of the mortgage. Here you will find what we do, what it costs and how long it takes; we will give you the exact figure in a written approximate written quote in a short time.

What does the notary do for a mortgage?

The bank lends money in exchange for a mortgage lien on the property, and the lien is only created through a public deed registered in the land registry. Before signing, we prepare the notarial report that the bank requires: twenty years of title history, mortgage and cadastral searches, confirming that the property is free of other charges and that whoever is mortgaging it is really its owner. We go through the draft contract with you (rate, spread, repayment schedule, insurance policies, penalties, termination clauses) and explain what each line means. On signing day we receive the mortgage contract and register the lien. If the mortgage is for a purchase, we coordinate the disbursement with the purchase deed, so the seller receives the price and you receive the keys. In later years we handle refinancing and assumption; assumption applies when you sell a property with a mortgage still running and the buyer takes it over. We also handle splitting and discharge of the mortgage, when a deed is needed.

How much does a notary cost for a mortgage in Naples?

A mortgage has its own tax regime, set out in articles 15-18 of Presidential Decree 601/1973: instead of registration, stamp, mortgage and cadastral tax, a single substitute tax is paid, withheld by the bank. The notary’s fee covers the mortgage report, the deed and registering the lien, and grows with the loan amount; the expenses include searches, archive tax and the mortgage registration tax.

TransactionTaxesWho pays the notary
Mortgage for a main home (purchase, construction, renovation)substitute tax 0.25% of the loan amountthe borrower
Mortgage for other properties or a second homesubstitute tax 2% of the loan amountthe borrower
Refinancing (moving to another bank)nonethe new bank
Assumption of the mortgage in a saleno extra tax, declared in the purchase deedas agreed between the parties
Discharge of the mortgage once repaidnone: the bank notifies the land registry (art. 40-bis of the Consolidated Banking Act)no notary needed, except in special cases

An example: a €150,000 mortgage for a main home in Bagnoli. Substitute tax: €375 (0.25%). If the same property were a second home: €3,000 (2%). The mortgage lien is registered for an amount higher than the loan, usually 150-200%, and this is normal: it covers interest and costs, not extra debt. To estimate the tax and instalment you can use the mortgage calculators; you will find the notary’s fee in the quote, shown separately from the taxes as the code of professional conduct requires.

Substitute tax (withheld by the bank)375.00 €
Mortgage registration tax35.00 €
Total tax410.00 €
Substitute tax of 0.25% or 2% (articles 15-18, Presidential Decree 601/1973), for bank mortgages over 18 months. The notary’s fee is not included: for a mortgage on a main home it is halved by law (art. 39(7) of the Consolidated Banking Act) and you will find it, line by line, in the written approximate quote. An informational estimate, it does not replace the quote.

Is the bank asking for a mortgage on your parents’ home too? Someone who gives a mortgage to secure someone else’s debt is a third-party mortgagor: they do not pay the instalments, but their property stays encumbered until the mortgage is reduced or the loan ends. This is not the same as a personal guarantee, which puts the whole estate on the line: before signing, we go through the draft together with whoever is acting as guarantor too.

Refinancing, assumption, discharge: when do you need a deed?

Refinancing (art. 120-quater of the Consolidated Banking Act) moves the mortgage to a bank with better terms: it needs a notarial deed, but the law forbids charging you any cost, and the whole process must be completed within 30 working days. Assumption applies when you sell a property that still has a mortgage on it and the buyer takes it over: it is recorded in the purchase deed, with or without releasing the original borrower, and the bank must agree. Discharge of the mortgage, since 2007, happens automatically once you finish paying; a notarial deed is only needed in special cases. For example, when you need to sell and the buyer is taking out a new mortgage. Or when the mortgage was registered before 2007 and the bank has not yet reported that it has been repaid.

What do you need to bring to the office?

The full list is on the Documents page.

How long does it take?

From the bank’s approval to signing, it usually takes two to three weeks: this covers the notarial report, the final draft and the seven-day reflection period the law gives you. On signing day, the mortgage and the purchase deed are signed one after the other. Some banks disburse immediately, others after the mortgage lien is consolidated (ten days after registration): in that case we agree in advance with the seller how to cover the wait. Refinancing takes around a month; a discharge deed is done in a few days.

Frequently asked questions

Can the bank impose its own notary?

No. The notary is chosen by whoever pays for the deed, meaning the borrower. The bank can set requirements the draft must meet, not choose the professional.

Is refinancing really free?

Yes: by law you cannot be charged costs, fees or taxes, and any clause that stands in the way is void. A notarial deed is still needed, but it is paid for by the new bank. This is different from a full substitution (a new mortgage and a new lien), which carries all the costs of a new mortgage.

I’m under 36: are there still benefits?

Full exemption from taxes for the under-36s ended in 2023; the Consap first-home guarantee fund remains. It guarantees up to 80% of the mortgage for young people with an ISEE (means-tested income indicator) of up to €40,000, and it was extended by the 2026 budget law. Details in First-home benefits under 36: what is left.

Can I pay off the mortgage early and pay less interest?

Yes, and with no penalty if you are an individual and the mortgage was for your home (art. 120-ter of the Consolidated Banking Act). Ask the bank for the settlement figure: interest is only due up to that date.
