When a parent or spouse dies, grief comes with a list of tasks on a strict timetable: the inheritance tax return within twelve months, accepting the estate, updating the land registry, often a house to divide or sell among siblings. This page explains what the firm does for you in Naples, how much an inheritance costs, which documents are needed and how long it takes. For a precise figure, ask for a written quote: in a short time.

What does the firm do for you in an inheritance?

We start with a consultation where we reconstruct the family and the estate: who the heirs are and whether there is a will. If it is a handwritten (holographic) will, it must be published by a notary before it can be used. Next we check which real estate, accounts and shareholdings there are. Then we prepare the electronic inheritance tax return with automatic land-registry updates. We handle the acceptance of the estate and its registration in the property registers: that is what later allows the inherited home to be sold or mortgaged. If debts exceed the assets, we handle a renunciation instead. When there is more than one heir, we draft a division deed with any balancing payments. If an heir is a minor or under a support administration, we obtain the authorisation that used to take months in court. Finally, if the inherited home is to be sold, we handle the sale already knowing the full history of the property.

How much does an inheritance cost in Naples?

Here too there are three items: the taxes (the same everywhere, paid by the heirs); the firm’s fee for the return and for any notarial deeds required; the costs (searches, stamp duties, archive fee, certificates). The taxes depend on the degree of kinship and the value of the assets:

Who inherits Inheritance tax Allowance (per heir)
Spouse, children, parents (direct line) 4% €1,000,000
Siblings 6% €100,000
Other relatives up to the 4th degree, in-laws up to the 3rd 6% none
Everyone else 8% none
Heir with a severe disability according to kinship €1,500,000
Real estate (in addition) mortgage tax 2% and land-registry tax 1% on the cadastral value (minimum €200 each); a flat €200 + €200 if the heir meets the primary-residence requirements

An example: a father leaves his two children a flat in Soccavo with a cadastral income of €700 and €40,000 in a bank account. Cadastral value of the property: 700 × 1.05 × 120 = €88,200. Inheritance tax: zero, because each child is well under the one-million threshold. Taxes on the property: mortgage tax 2% = €1,764 and land-registry tax 1% = €882; if one of the children claims the primary-residence relief, these become a flat €200 + €200 for the whole estate. On top of this come the fee for the return and, if needed, for the acceptance or division: we set these out in the quote. For an immediate estimate, use the inheritance-tax calculator (Italian).

Do you really need a notary for an inheritance?

For the tax return alone, no: it can be filed by the heirs, a tax-assistance centre or an accountant. A notary is required for acceptance with the benefit of inventory (compulsory for minors and incapacitated heirs, advisable when there are debts). One is also required for a renunciation, for the division of real estate, for publishing a will and for a sale. The advantage of doing everything at the firm is that the return is prepared with an eye to what comes next: cadastral values consistent with a future sale, the acceptance registered at once, the primary-residence relief claimed by the right person.

The list of documents tailored to your inheritance, in four questions, is on the page Prepare your request (Italian): your browser answers, nothing is sent to anyone. The complete, document-by-document list, with who obtains each paper, is in the guide how to prepare an inheritance (Italian).

How long does it take?

Once the documents are gathered, the tax return is filed in one or two weeks and the land-registry updates follow automatically. Acceptance or renunciation is signed at a single appointment; a division takes a few weeks to settle shares and balancing payments. If an heir lives abroad or cannot come, it is done with a power of attorney (Italian). The limit not to exceed is twelve months from death: beyond that, penalties and interest apply, even though a late return remains possible.

Frequently asked questions

If there is no real estate, do I still have to file the tax return?

No, if the estate goes to the spouse and direct-line relatives, does not include real estate, and the assets do not exceed €100,000. In every other case, yes, even when no tax is due.

Can I renounce the inheritance if there are debts?

Yes, with a declaration before a notary or a court, provided you have not already accepted the estate, even tacitly (for example by selling an asset). Alternatively, acceptance with the benefit of inventory limits your liability to the assets you actually receive.

We are three siblings and one wants to keep the house: how is that done?

With a division deed: the house goes to one sibling and the others receive a balancing payment in cash or other assets. A division with a balancing payment is subject to a 1% registration tax on the estate; if the balancing payment exceeds the sibling’s rightful share, the excess is taxed as a sale. We cover this in Dividing an inherited house (Italian).

I live abroad: do I have to come to Naples?

Not necessarily. The tax return and the acceptance can be done with a power of attorney issued by the Italian consulate or by a local notary with an apostille; we prepare the text. Special rules apply for minor heirs living abroad, explained in Minors living abroad (Italian).
